Setting Boundaries


"Your right to swing your arms ends just where the other man's nose begins."


Various permutations of this quote have been attributed to Holmes, but its was actually written by Zechariah Chafee,(Jr.) "Freedom of Speech in Wartime", 32 Harvard Law Review 932, 957 (1919).

Zechariah Chafee, (Jr.)was an American judicial philosopher and civil libertarian. An advocate for free speech, he was described by Senator Joseph McCarthy as "dangerous" to the United States. Legal scholar Richard Primus called Chafee “possibly the most important First Amendment scholar of the first half of the twentieth century.”

*The problem of misattributing quotes is something that seems like a kind of laziness.  It comes from repeating what someone else has said without checking on thier sources.

An example of Misattributed version of the above quote: Oliver Wendell Holmes Jr. said, “The right to swing my fist ends where the other man’s nose begins.”  was what got my interest and caused me to double check the quote.  I like the bastardized version but would have looked dumb saying Holmes said it.
